Texas Skimmer Law

HB2945 has passed the Texas State Legislature and is scheduled to go into effect September 1, 2019.  This new law outlines basic measures locations should take to protect consumers against skimming devices and what penalties merchants could face for non-compliance.

Merchants may be fined between $1,000 and $5,000 per violation if the Department of Agriculture or Attorney General’s office determines any of the following:

  • Merchant failed to report the incident within 24 hours of finding
  • Three or more instances  within a 24-month period
  • Failure to comply with investigation
  • Failure to use industry best practices for prevention

Any fees or fines received in accordance with HB2945 will be the sole responsibility of the location owner.
